General Terms of Use

The website cookwork.be is managed by SCRL Cookwork, whose registered office is located at rue Josse Impens 30, 1030 Brussels, and is registered with the Banque Carrefour des Entreprises under number BE 0695.853.452, hereinafter referred to as “the Platform” or “Cookwork.”
Cookwork is a platform that connects owners of kitchens approved for professional production with professionals in the food or event sectors.

1. Definitions and General Provisions

  • Cookwork: the website www.cookwork.be

  • Members: users registered on the website www.cookwork.be

  • Hosts or Owners: natural or legal persons offering the rental of a professional kitchen

  • Tenants: natural or legal persons wishing to rent a professional kitchen

  • Host Services: rental of kitchens for production or other uses, activities for one or more days across various categories, access to unique events and venues

These General Terms of Use (the “Terms”) apply to the Services (website, mobile, tablet, and smartphone applications) provided by Cookwork.
Access to and use of the website www.cookwork.be implies full and unconditional acceptance of these Terms. They may be modified at any time and without prior notice to adapt to legislative and regulatory changes or to modify the functionalities offered. Consequently, it is your responsibility to regularly review these Terms to be aware of any modifications.

2. Scope of Cookwork Services

Cookwork is a platform that connects Owners and Tenants and allows Members to post announcements for Host Services, process reservation requests for Host Services, and facilitate communication and exchanges between Members in order to conclude a contract between them.

Cookwork is not an Owner and does not create, provide, control, manage, or offer Host Services. Contracts are concluded directly between Tenants and Owners. The latter are solely responsible for their announcements and Host Services. Cookwork is a third party to the contract entered into between Members and does not act as an agent for any Member.

Members are solely responsible for the quality, safety, legality, truthfulness, and accuracy of the announcements or Host Services. Cookwork does not guarantee, nor exercise any control over, the capacity of Owners or Tenants. Each Member acts on their own behalf and for their own benefit—not on behalf of Cookwork. Consequently, a Member cannot be considered an employee, agent, or partner of Cookwork.

In order to increase the visibility of Cookwork and the announcements, the Members’ Content may also be distributed on other websites, in applications and emails, and through advertisements. To ensure that the announcements and Members’ Content benefit from wider distribution, they may be translated, in whole or in part, into other languages. Cookwork cannot guarantee the accuracy or quality of these translations. Members are responsible for verifying the accuracy of such translations.

3. Hypertext Links and Site Management

Cookwork provides, strictly for informational purposes, links via hypertext to other sites. It is strongly advised that, when visiting these sites, you review their policies regarding the protection of personal data. Cookwork disclaims any responsibility for the practices, services, or information of the sites to which you may be directed via such links.

Cookwork will make every effort to ensure optimal navigation and use of the Platform, but cannot be held responsible in the event of unavailability, malfunction, temporary inaccessibility, or interruption. Cookwork reserves the right to limit the availability of the Platform or certain features in order to preserve the security or integrity of its servers or to perform maintenance.

Cookwork reserves the right to modify or add new services or functionalities at any time.

4. Access – Registration on Cookwork

By accessing and registering on Cookwork, the internet user or Member certifies that they are at least 18 years old and have the capacity and authority to contract. Cookwork reserves the right to subject access to certain features to specific conditions or verification procedures.

Cookwork also reserves the right to request from Members a copy of their identity card or any other information required to verify the identity, accuracy, and quality of the information provided by the Members.

5. Creation of an Account

Access to certain features of Cookwork requires the creation of a Cookwork Account.
To create a Cookwork Account, the Member must have an email address and a password.

When creating a Cookwork Account on behalf of a legal entity, the Member certifies that they have the authority to legally bind that entity and to grant us all the authorizations and licenses provided for in these Terms.

The Member agrees to provide accurate, up-to-date, and complete information during the registration process and to keep both the information in their Cookwork Account and that on the public profile page updated.
The Member agrees to create and use only one Cookwork Account unless otherwise authorized.
The Member is solely responsible for the use of their Cookwork Account, as well as for the confidentiality and security of their account credentials and password. They are prohibited from sharing this information with any third party. In the event of loss, theft, or unauthorized use of a Cookwork Account, the Member agrees to immediately notify Cookwork.

6. Content

Cookwork provides Members with the means to create, upload, publish, send, receive, or store Content (text, photos, recordings or videos, and other documents and information) on the Cookwork Platform.

Members are solely responsible for the Content they publish on Cookwork. They agree to comply with all applicable laws and regulations (including intellectual property rights and property laws). They are prohibited from publishing any Content that is illegal, fraudulent, obscene, defamatory, threatening, slanderous, or that incites discrimination, racism, intolerance, hate, or harm against an individual or a group.

You must immediately inform Cookwork by email at contact@cookwork.be if you believe that any Content on the Cookwork Platform violates your copyright.

All content (texts, drawings, photos, illustrations, films, data, logos) published by Cookwork on this site is protected by intellectual property rights. Any copying, adaptation, translation, arrangement, or modification of all or part of this content, in any form and by any means, is strictly prohibited without the prior written consent of Cookwork. Any infringement may result in civil or criminal proceedings.

By creating, uploading, publishing, sending, receiving, storing, or otherwise making available any Content on Cookwork, you grant Cookwork a non-exclusive, worldwide, royalty-free, irrevocable, and perpetual license to use, store, reproduce, modify, create derivative works from, distribute, publish, transmit, broadcast, and otherwise exploit such Content in order to provide and/or promote Cookwork on any medium. Unless you provide written consent, Cookwork will not claim any ownership rights over any Member Content, and no clause in these Terms shall be deemed to limit your rights to use or exploit your Member Content.

7. Service Fees

Fees will be charged to Owners and/or Tenants in exchange for the use of and services provided by the Cookwork Platform. These fees are communicated prior to the posting of an announcement or the reservation of a Host Service.

Cookwork reserves the right to modify the service fees. In such a case, Members will be notified within a reasonable period.
Unless otherwise stated, service fees are non-refundable.

8. Obligations of the Owners

By publishing Content and/or an announcement, Owners agree to:

  • Provide complete and accurate information regarding the Host Service, including a description of the kitchen, its location, and the dates and duration of its availability.

  • Provide photos or videos that reflect the quality of the Host Services, noting that Cookwork reserves the right to impose a specific format, size, resolution, and minimum number.

  • Specify any restrictions, requirements, or qualifications needed for the use of the kitchen.

  • Indicate any deficiencies or malfunctions of the equipment offered for rental, and provide any additional information requested by Cookwork.

  • Keep the Content and announcements updated.

  • Offer only one space per announcement.

  • Offer a space that they own or are entitled to sublet.

  • Comply with any agreements made with third parties, such as co-ownership regulations, and adhere to applicable laws (such as urban planning laws), tax obligations, and other rules and regulations (including obtaining all necessary permits, licenses, and registrations).

Owners are solely responsible for setting the price (including applicable taxes) for the Host Services, above the minimum set by the Cookwork platform. It is forbidden to request a price higher than that stated in the reservation request.

By accepting or pre-approving a Tenant’s reservation request, the Owner is obligated to provide the Host Service(s) to the Tenant as described in the announcement on the date of the reservation request.

Owners must obtain appropriate and sufficient insurance for their Host Services, ensuring their civil and professional liability and covering the risks of damage to third parties.

Any guarantee requirement for the rental of your kitchen must be mentioned in the announcement prior to any reservation confirmation.

9. Obligations of the Tenants

Tenants agree to:

  • Book the Host Services by following the appropriate reservation procedure.

  • Pay all applicable fees: the displayed price, any guarantee, applicable taxes, and any other fees indicated at the time of reservation.

  • Vacate the kitchen no later than the deadline specified by the Owner in the announcement, or at another mutually agreed time. In the event of occupation beyond the specified deadline, the Owner reserves the right to charge in 4‑hour increments at a rate twice the average hourly rate displayed.

Upon receipt of a reservation confirmation from Cookwork, a contract is concluded between the Tenant and the Owner, subject to specific cancellation conditions or restrictions. Cookwork will collect the total fees at the time of the reservation request or upon the Host’s confirmation.

In the case of a reservation made on behalf of additional Tenants, each of them must comply with the conditions defined by the Owner and these Terms. Any confirmed kitchen reservation is limited to the space granted by the Owner, who retains the right to re-enter or occupy the kitchen in accordance with the agreement made with them.

10. Modification, Cancellation, and Refunds of Reservation

Members, whether Owners or Tenants, are responsible for any reservation modifications they make or request from Cookwork. They agree to pay all fees resulting from such modifications.

Tenants may cancel a confirmed reservation at any time, subject to the Owner’s cancellation conditions, and Cookwork will refund the Tenant in accordance with those cancellation conditions. Unless otherwise specified, all amounts due to the Owner under the cancellation conditions will be paid by Cookwork in line with the payment terms.

In the event of a reservation cancellation by the Owner, Cookwork will fully refund the Tenant. Cookwork will publish a comment indicating that a reservation has been cancelled.

In certain cases, Cookwork reserves the right, at its sole discretion, to cancel a confirmed reservation and carry out the appropriate refunds and payments.

11. Ratings and Reviews

After finalizing a reservation, Cookwork offers a public review and a star rating system regarding the Owners and Tenants. These reviews and ratings must be fair, sincere, and factual, and they reflect only the opinions of the respective Owners and Tenants. Cookwork does not verify the published ratings and reviews.

Members are prohibited from manipulating or altering the rating and review system, for example by asking a third party to write a positive or negative review about another Member.

12. Damage to the Premises

The Tenant is required to return the kitchen in the condition in which it was found. They are responsible for their actions or omissions, as well as for those of any person they invite or allow access. The Tenant agrees to compensate the Owner in the event of proven damage to the Owner’s personal belongings or other property. Cookwork reserves the right to recover any amounts due from the security deposit.

Members agree to cooperate with Cookwork in resolving disputes arising from the provision of Host Services and to participate in mediation or any amicable dispute resolution procedure.

13. Taxes

The Owner is solely responsible for any obligations related to declaration, collection, payment, or any fiscal responsibilities (including applicable VAT or other indirect taxes, occupancy taxes, etc.).

14. Prohibited Activities

Members may not:

  • Use Cookwork for commercial purposes or for any purposes not expressly authorized by these Terms, or in any manner that might falsely imply Cookwork’s endorsement, the existence of a partnership with Cookwork, or otherwise mislead regarding your relationship with Cookwork.

  • Reproduce, store, access, or use in any manner any information—including personal information about any other Member—available on Cookwork in violation of these Terms or in a way that infringes upon the privacy rights of Members or third parties.

  • Distribute unsolicited commercial messages.

  • Make or accept a reservation outside of the Cookwork Platform in order to avoid service fees or for any other reason.

  • Accept or make payment of the displayed price outside of the Cookwork Platform.

  • Discriminate against or harass any person on the basis of ethnic or national origin, religion, gender, sexual identity, physical or mental disability, health status, marital status, age, or sexual orientation, or engage in any violent or disruptive behavior.

  • Use the word “Cookwork” or any derivative thereof in domain names, trade names, trademarks, or other source identifiers in a manner likely to cause confusion with Cookwork.

  • Take any action that disrupts or harms (or could disrupt or harm) the performance or proper functioning of Cookwork.

  • Use robots, spiders, crawlers, scrapers, or any other automated means or processes to access the Cookwork Platform, retrieve data or other content from the Cookwork Platform, or interact with the Cookwork Platform for any other purpose.

Cookwork is under no obligation to monitor or control the use of the Cookwork Platform by any Member. However, to help prevent fraud, Cookwork will comply with applicable law, administrative, or judicial injunctions from public authorities.

Any behavior by a Member deemed inappropriate must be reported immediately to Cookwork. Members agree to cooperate fully with Cookwork and to take any reasonable measures requested by Cookwork in connection with any investigation into the use or misuse of the Cookwork Platform.

15. Duration and Termination

This Agreement is concluded for an indefinite period from the moment the Member accepts these General Terms of Use.
Each Member may terminate this Agreement at any time by using the “Close Account” function on the Cookwork Platform or by sending us an email.

In the event of the deletion of a Cookwork Account, any confirmed reservations will be automatically cancelled, and Tenants will receive a refund in accordance with our cancellation conditions.

Cookwork reserves the right to immediately terminate this Agreement without notice:

  • In the event of a substantial breach of the obligations set forth in these Terms, failure to comply with applicable laws and regulations, or infringement of third-party rights;

  • In the event of fraudulent behavior by a Member.

In the event of termination of this Agreement, Cookwork reserves the right not to reactivate and/or restore the Cookwork Account or any of your Member Content. Any Member whose Cookwork Account has been suspended may not create a new Cookwork Account, access the Cookwork Platform, or use it via another Member’s account.

16. Personal Data

All personal data necessary for processing the Host Services is retained by Cookwork or its collaborators and may not be transmitted to companies with which Cookwork collaborates.

Furthermore, the Member authorizes Cookwork to use such data to compile statistics in order to improve the services offered. This information may also be used to disseminate information regarding Cookwork’s business activities by any means of communication.

Cookwork also retains personal data to facilitate future requests. Without prejudice to the foregoing, Cookwork undertakes not to disclose any personal information it holds to another company or entity outside of the rental service provided in its business.

The data retained by Cookwork may be requested and corrected at any time upon simple request. Such a request should be sent by email to contact@cookwork.be or by postal mail addressed to:

17. Governing Law and Jurisdiction

These Terms shall be governed by Belgian law. The choice of applicable law shall not affect your rights as a professional under the consumer protection regulations in force in your country of residence.

For an amicable resolution of any dispute arising from an online sale contract for goods or services, the consumer may also contact our services directly at contact@cookwork.be or use the online dispute resolution platform established by the European Commission, available at:

Cookwork further attests that it is not affiliated with any out-of-court dispute resolution body.
Any dispute arising between the parties, whether regarding the interpretation or execution of these Terms, that is not resolved amicably shall be subject to the exclusive jurisdiction of the courts of Brussels.
